The China Post August 12, 2010 By Lin Chang-Shun and Sofia Wu, CNA TAIPEI — A lawyer and his girlfriend were taken into custody Thursday as part of a probe into a bribery case that implicates at least one Taiwan High Court judge. The Taipei District Court agreed to a prosecutorial request to detain Chiu Chuan-shun and his girlfriend Tuan Mei-yueh to facilitate investigations into a bribery case involving Yang Ping-chen, a Taiwan High Court judge. Prosecutors applied for detention of Chiu and Tuan late Wednesday after questioning them and many others about their alleged involvement in the corruption case. Prosecutors and investigators raided 20 locations in major cities in northern Taiwan Wednesday in a new drive to root out corruption in the judiciary. Among the locations searched were the residences of Yang and Chiu, a high court spokesman said. more …

Article 20 of 20 “America and China’s tumultuous relationship over the past sixty years has trapped the inhabitants of Taiwan in political purgatory. During this time the people on Taiwan have lived without any uniformly recognized government. In practical terms, this means they have uncertain status in the world community which infects the population’s day-to-day lives. This pervasive ambiguity has driven Appellants to try to concretely define their national identity and personal rights.” Thus opened an 11-page decision of the District of Columbia U.S. Court of Appeals last year in the case Roger C.S. Lin, et al vs. United States of America. Judge Janice Rogers Brown authored the opinion of the federal appellate court in a case that sought use of United States passports for the residents of Taiwan until its international status can be resolved. The court noted that the United States was named the “principal occupying Power” of Taiwan by the San Francisco Peace Treaty [SFPT] that officially ended World War II between the United States and Japan. However, sovereignty of the island was deliberately left undetermined and resulted in “decades of ‘strategic ambiguity’ with respect to sovereignty over Taiwan.” Sympathetic that the court was with the plight [...]

Taiwan News 2010-07-27 TAIPEI (Taiwan News) – The Taiwan High Court on Tuesday cut a prison sentence for a key aide to former President Chen Shui-bian to seven months from nine years. Chen Che-nan, no relation of the ex-president, was found guilty by a lower court of misusing his function as presidential deputy secretary-general to defraud a construction tycoon of NT$6 million (US$187,000). Chen reportedly offered the businessman to help him change the outcome of a court case. The original sentence was 12 years in prison. The Taiwan High Court then cut Chen’s prison sentence to nine years, but both prosecutors and attorneys for the official filed protests with the Supreme Court, which ordered a new ruling. In the reversal Tuesday, the High Court ruled that Chen did not use his function to obtain the money, so the charge he was found guilty of should be changed to common fraud. Under rules applying to the kind of charges, the regular sentence of 14 months in prison was cut to seven months. more …

mysinchew.com 2010-07-16 17:03 TAIPEI, Friday 16 July 2010 (AFP) – Taiwan’s former president Chen Shui-bian on Friday claimed that two properties he owned in the United States were bought with legitimate funds after the US government sought to expropriate them. The US government went to court Wednesday seeking to expropriate the properties, allegedly bought with bribe money Chen and his wife received while in power. But Chen’s office refuted the allegations saying in a statement: “The Chen family bought the two houses with political donations… the money was not ill-gotten and it is too flimsy for the (US authorities) to jump to any conclusion. “We will collaborate with the US judicial department in its investigation to clarify the case and return justice to the Chens,” it said. According to the civil forfeiture complaint filed in New York and Virginia, former first lady Wu Shu-chen was paid six million dollars to prevent her husband’s government from interfering with a company’s takeover bid for a rival firm in Taiwan. more …

AP July 15, 2010 TAIPEI, Taiwan — The United States is seeking to take over two properties in New York and Virginia owned by former Taiwanese President Chen Shui-bian and his wife, who were convicted in Taiwan on corruption charges last year. The U.S. Justice Department filed complaints Wednesday in New York and Virginia alleging part of $6 million paid in bribes to Chen’s wife, Wu Shu-chen, was used to purchase an apartment in Manhattan and a house in Keswick, Virginia. According to the complaints, Taiwan’s Yuanta Securities Co. Ltd. paid the bribe to ensure its bid to acquire additional shares in the island’s Fuhwa Financial Holding Company Limited would not be blocked by authorities. “A portion of these bribe proceeds were then transferred … to the United States and used to purchase a condominium in Manhattan” and a house in Virginia, the complaints allege. more …

AFP July 7, 2010 HANOI — Vietnamese police have arrested 99 people from China and Taiwan for international phone and Internet fraud that allegedly led to millions of dollars in losses, state radio reported Wednesday. The arrests took place between late June and last week in southern Ho Chi Minh City, Voice of Vietnam said, citing the Ministry of Public Security. It said the suspects included 76 Taiwanese and 23 Chinese. Police seized telecommunications equipment, computers and telephones, the report added. Major General To Lam told the radio network that the criminals often took over entire hotels of 30 to 40 rooms for their operations.
